Offenses Related to Missouri DWI

Often, a DWI is not the only citation that a driver receives. Other tickets that may also be issued may be for speeding, failing to maintain a single lane, failure to obey a traffic signal, etc. Those traffic tickets, while considered moving violations, are less serious and carry only fines as punishment. What follows below is a list of offenses that also get charged with a DWI frequently but that have much harsher penalties.

DRIVING WHILE SUSPENDED: Driving while suspended, cancelled or revoked is a Class A misdemeanor. If you are suspended for a DWI, your second driving while revoked is a Class D Felony. If you have prior alcohol related law enforcement contacts and get convicted of driving while revoked a third or fourth time within a ten year period, and have previously done time for driving while suspended, it is a Class D Felony.

MINOR IN POSSESSION: A minor in possession charge may be filed whenever a person under the age of 21 possesses alcohol. Minor in possession of alcohol is a misdemeanor. There may be community service and some alcohol education classes ordered by the court. The minor will also be subject to the "Abuse and Lose" law which can result in driver's license suspension/revocation.

POSSESSION OF SUSPENDED OR FAKE DRIVER'S LICENSE: It is illegal for any person to possess their plastic driver's license when it has been suspended, canceled, or revoked. A fake I.D. possessed for the purpose of obtaining alcohol by a person under the age of 21 is a misdemeanor and carries a fine of $500.00. Possessing a fake I.D. also subjects a person to losing his or her license under the "Abuse and Lose" law.
